The following conciliation formula was agreed between the Military Industry - Indumil and the Importer and Distributor of Colombia SAS - Imdicol SAS:
1. “Repeal the Synergy Official Letter 02.539.853 of February 8, 2022 through which Imdicol SAS was contractually sanctioned and the Synergy Official Letter 02.531.167 of January 14, 2022 through which the contractual sanctioning procedure was initiated.
2. “Go to cause 1 of article 93 of Law 1437 of 2011: “When your opposition to the Political Constitution or the law is manifest.”
3. “Return the money withheld and requested by the calling party, which amounts to the sum of forty-seven thousand six hundred and seventy-eight dollars (US$47,678.00).”
4. “Propose only the return of capital, without any type of interest or indexation.”
5. “Settle the contract by mutual agreement. Within the draft liquidation document, include and establish that: i) Forty-seven thousand six hundred and seventy-eight dollars (USD$47,678.00) will be delivered, ii) the Military Industry received four hundred (400) brand pistols Pietro Beretta, after September 6, 2021 and iii) the waiver of both parties to any subsequent judicial or extrajudicial action that has been attempted or could be attempted on the occasion of the Imported Sale Contract 1-002/2021, its execution and settlement.
6. “With respect to the deadlines to complete each stage of settlement of the contract, given that a settlement proposal has already been prepared, it will be communicated to the contractor during the conciliation process, that is, on September 12, 2022, with in order for you to express your observations during the hearing that will take place on September 19, 2022, within the conciliation process.”
7. “In the event that the conciliation formula is accepted by the convener and is judicially approved, the disbursement of the forty-seven thousand six hundred and seventy-eight dollars ($47,678.00) will be made within thirty (30) days following the execution of the order that judicially approves the conciliation and the signing of the liquidation act. That is, taking into account the administrative procedures, once the conciliation has been judicially approved and the liquidation document signed by the convener, the entity will have thirty (30) days to make the disbursement.”
The term granted in the procedure of September 19, 2022 is three (3) days, that is, by September 22, 2022 - the date on which the file will be sent to the competent administrative court - this publication should already be found available on the entity's website.
